Welcome to Mun Health. These Terms of Service ("Terms") govern your access to and use of our services, website, digital tools, Nova our AI support companion/chatbot tool, online software application (the "Software"), and any associated content or services (collectively, the "Services"), provided by Mun Health ("Company", "we", "our", or "us"). By accessing or using the Services, you agree to comply with and be bound by these Terms. If you do not agree, do not use our Services.

General Terms of Use

  1. You must be at least 18 years old to use the Services.
  2. By registering, accessing, or using the Services, you confirm that you are at least 18 years old and have the legal capacity to enter into these Terms.
  3. If you are using the Services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.
  4. Users are responsible for maintaining the confidentiality of their account credentials and for all activities conducted through their account(s). Notify the Company immediately at info@munhealth.org if you suspect any unauthorized access or activity.
  5. Nova is an AI-based tool that generates responses based on algorithms and is not capable of clinical judgment. Users acknowledge that AI-generated information may not always be accurate or applicable to individual circumstances.

Purpose of the Services

  1. The Services are designed to provide general support, resources, and information tailored to assist individuals managing chronic illnesses. The Services are not intended to replace professional medical advice, diagnosis, or treatment. Always consult with a qualified healthcare professional regarding any health-related decisions or concerns.
  2. The Services are not intended to diagnose, treat, cure, or prevent any disease, and are not regulated as a medical device by the FDA. Use of the Services is not a substitute for professional medical advice, diagnosis, or treatment.
  3. The Service’s features, including AI functionality, may be updated, modified, or discontinued without prior notice. Users agree that Mun Health is not liable for any changes to or discontinuation of the Services.
  4. Non-Clinical Nature: The Services do not prescribe professional medical, psychiatric, or nutritional advice, diagnosis, or treatment.
  5. Crisis or Emergency: This Services are not suitable for crisis intervention. In the event of an emergency, please contact a healthcare provider or emergency services.
  6. Mun Health is committed to providing accessible services to all users, including individuals with disabilities. Please contact us if you encounter any accessibility barriers.

Prohibited Uses and Activities

You may use our Services only for lawful, personal, and non-commercial purposes.

By using the Services you agree not to:

  • Use the Services to seek professional medical advice, physical distress, or crisis intervention.
  • Use the Services for unlawful purposes.
  • Transmit any harmful or malicious content, including viruses or malware.
  • Engage in unauthorized data collection, scraping, or automated access of the Services.
  • Impersonate another individual or entity.
  • Misuse or interfere with any system or network.
  • Use automated tools to access or disrupt our Services.
  • Attempt to reverse-engineer, copy, modify, or exploit the Services for any purpose.

Intellectual Property Rights

  1. All content, design, branding, functionality, software, tools, trademarks, graphics, and other materials associated with the Services are the exclusive property of Mun Health or its licensors and protected under applicable copyright and intellectual property laws.
  2. Unauthorized use, duplication, or distribution of any intellectual property is prohibited.

Third-Party Links and Content

  1. The Services may include links to third-party websites or display third-party content.
  2. Mun Health is not responsible for the accuracy or practices of such third parties.

Limitations of Liability

  1. Mun Health and its affiliates are not liable for any direct, indirect, incidental, or consequential damages arising from the use of the Services or reliance on its content, including AI-generated advice and responses. This limitation includes, but is not limited to, loss of data, loss of profits, or personal injury resulting from errors, omissions, or misuse of the Services.
  2. No Guarantees: The Services are provided “as is” and without any warranties, express or implied.
  3. No Liability for Outcomes: Mun Health is not responsible for any decisions, actions, or inactions taken by you based on the information or interactions provided by the Services.
  4. No Liability for Technical Issues: We are not liable for any interruptions, errors, or damages arising from the use or inability to use the Services.

Payment Terms

If the Services involve any paid features:

  1. Subscription Fees: Users must pay applicable fees as outlined in the pricing plan.
  2. No Refunds: Fees are non-refundable unless required by law.
  3. Billing Information: Users are responsible for keeping payment information accurate and up to date.

Data Privacy and HIPAA Compliance

  1. Privacy and Security: We collect, store, and use personal data in compliance with applicable privacy laws such as HIPAA, CCPA, and other state-specific laws and regulations, as well as in accordance with our Privacy Policy.
  2. Protected Health Information (PHI): If your use of the Services involves the sharing of PHI, we will comply with the HIPAA Privacy, Security, and Breach Notification Rules to the extent we qualify as a covered entity or a business associate.
  3. Business Associate Agreement (BAA): If you are a covered entity or business associate under HIPAA and intend to share PHI through the Services, you agree to enter into a BAA with us. Absent a BAA, you agree not to use the Services in a manner that creates obligations under HIPAA for Mun Health.
  4. User Responsibilities:
    • Do not upload or share PHI beyond what is necessary for the Services to function.
    • Ensure that any information you provide has been collected and disclosed to us in accordance with all applicable HIPAA and state privacy regulations.
    • The Services are not intended to serve as the primary repository for any medical records or health data. Users are responsible for maintaining their own personal health records independently of the Services.
  5. Security Measures: We use administrative, physical, and technical safeguards (including encryption in transit and at rest) designed to protect PHI. However, you acknowledge that no system can perfectly guard against all risks of data breaches.
  6. Data Breach Notification: In the event of a breach of PHI, we will comply with HIPAA’s Breach Notification Rule, including notifying you and/or the appropriate authorities as required by law.
  7. Limitations: The Services, including Nova (AI support tool), are not intended for use as a primary repository for medical or health data. You acknowledge that any PHI shared with the Services or chatbot are at your discretion and risk, and you agree to handle such data in compliance with HIPAA requirements.

User Guidelines

  1. Engage with the Services respectfully and responsibly.
  2. Avoid sharing sensitive personal information unless necessary for Service use.
  3. Report any inappropriate behavior or technical issues to info@munhealth.org.

User Contributions

  1. Ownership: If you provide feedback, suggestions, or other input to the Services, you grant Mun Health a non-exclusive, royalty-free, perpetual license to use, reproduce, and distribute your contributions.
  2. Responsibility: You confirm that your contributions do not infringe on the rights of others or violate applicable laws.

Disclaimers and No Guarantees

  1. The Services do not guarantee specific outcomes or results.
  2. While efforts are made to provide accurate information, the Services are not responsible for errors or omissions.
  3. Services are provided “as is” without warranties of any kind. We do not guarantee uninterrupted or error-free use, nor do we guarantee that Services will respond accurately to all inquiries.

Termination of Use

Mun Health reserves the right to terminate or suspend access to the Services at its sole discretion, including for any violation of these Terms or misuse of the Services.

SMS Terms and Conditions

Mun Health and its affiliates (“We” or “Us”) are offering a mobile messaging program (the “Program”), which you agree to use and participate in subject to these SMS Marketing Terms and Conditions (the “Terms”).  By opting in to or participating in any of our Programs, you accept and agree to these terms and conditions.  PLEASE READ THESE TERMS CAREFULLY, AS THEY CONSTITUTE A LEGAL AGREEMENT BETWEEN YOU AND US.

  • User Opt In: Program allows users to receive SMS/MMS mobile messages or other marketing and informational communications by opting into the Program, such as through online or application-based enrollment forms or by texting a keyword to one of our phone numbers (such as a traditional 10-digit phone number or a toll-free number) or “short codes” (a 5 or 6-digit number that We use to exchange SMS/MMS with you), to which you may need to respond to confirm your opt-in.  Regardless of the opt-in method you used to join the Program, you agree that these Terms apply to your participation in the Program.  By participating in the Program, you agree to receive text messages, including automated text messages, at the phone number associated with your opt-in, and you understand that consent to these terms is not required to make any purchase from Us.  While you consent to receive messages and calls sent using an autodialer, this shall not be interpreted to suggest or imply that any of Our mobile messages are sent using an automatic telephone dialing system (“ATDS” or “autodialer”), and you and We agree that the system we use to send Our messages is not an ATDS.
  • User Opt Out: If you do not wish to continue participating in the Program or no longer agree to these Terms, you agree to reply STOP, UNSUBSCRIBE, REMOVE, CANCEL, END, QUIT, OPT OUT or ARRET to any mobile message from Us to opt out of the Program.  You may receive one additional mobile message confirming your decision to opt out.  You understand and agree that these opt-out options are the only reasonable methods of opting out.  You also understand and agree that any other method of opting out, including, but not limited to, texting words other than those set forth above or verbally requesting one of our employees to remove you from our list, is not a reasonable means of opting out.
  • Support Instructions: For support regarding the Program, text “HELP” in reply to the message you received from Us, or send Us an email at info@munhealth.org.  For further opt-out support, please contact our SMS platform provider, SlickText, at support@slicktext.com.
  • Cost and Frequency: Although We do not charge you for our messages, message and data rates may apply from your wireless carrier.  The Program involves recurring mobile messages, which may vary in frequency based on, among other factors, your level of interaction with Us.
  • MMS Disclosure: The Program will attempt to send SMS MTs (terminating messages) if your mobile device does not support MMS messaging.
  • Our Disclaimer of Warranty: The Program is offered on an "as-is" basis and may not be always available in all areas and may not continue to work in the event of product, software, coverage or other changes made by your wireless carrier. We will not be liable for any delays or failures in the receipt of any mobile messages connected with this Program. T-Mobile is not liable for delayed or undelivered mobile messages.
  • Participant Requirements: You must have a wireless device of your own, capable of two-way messaging, be using a participating wireless carrier, and be a wireless service subscriber with text messaging service. Not all cellular phone providers carry the necessary service to participate. Check your phone capabilities for specific text messaging instructions.

Updates to Terms

These Terms may be updated periodically. Continued use of the Services after updates constitutes acceptance of the revised Terms.
